User Agreement

OrientalFood, LLC encourages and promotes OrientalFood.com as an environment that encourages interaction and participation among its users("you"). User comments and contributions should be kept within the values and terms of our service and must comply with mandatory provisions of applicable laws. OrientalFood.com is provided as a free service to any user who agrees to abide by the terms of Service.

Please read this User Agreement carefully. ANY ACCESS AND USE OF THE SERVICE, CONFIRMS YOUR ACCEPTANCE, WITHOUT LIMITATION OR QUALIFICATION, ALL OF THE TERMS AND CONDITIONS IN THIS USER AGREEMENT. Service Provider reserves the right to change these terms and conditions at any time. Revisions to the User Agreement will appear on this screen. By using the Service, you agree in advance to accept any revisions or changes to this User Agreement. IF YOU DO NOT AGREE WITH THE RULES CONTAINED IN THIS USER AGREEMENT, PLEASE DO NOT USE THE SERVICE.

Users who violate the terms of service may permanently be banned from using the Service. Your failure to follow the rules and regulations of the Service, whether listed below or in future revisions, may result in termination of your access to the Service without notice.

The Service contains information, facts and opinions from various individuals and organizations. You acknowledge that you are using the service at your own risk. The service are provided on an "as is" basis. Neither OrientalFood, LLC nor its affiliates endorse or are responsible for the accuracy or reliability of any and all warranties of any kind, either express or implied, including, without limitation to warranties of title, non-infringement, accuracy, reliability or implied warranties of merchantability or fitness for a particular purpose, or any other warranty, condition, guarantee, representation, products, merchandise, information or services whether oral, written or in electronic form, including but not limited to the accuracy or completeness of any information advertised, contained therein, provided through or by the service, or the accuracy and results obtained from the use of any products, merchandise, or Information or services provided through or advertised on the service.

Service provider and its affiliates do not guarantee or warrant that (1)access to the service will be uninterrupted, (2)files available for downloading through the service will be free of infection by viruses or other code that may contain contaminating or destructive properties, or (3)that no failures, errors or omissions or loss of transmitted information will occur while using the service.

To the full extent permissible under the applicable law, Service Provider and its affiliates shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use orientalfood.com.

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. In no event shall Service Provider and its affiliates have any liability to you or any third parties for any incidental, consequential, punitive, direct or indirect damages (including, but not limited to, damages relating to loss of business, profits, goodwill, data, programs or information, and the like) arising out of your use of, inability to access or use the service or any information, advice, or services provided on or downloaded from the service or accessed on the internet from the service, including viruses alleged to have been obtained from the service, your use of or reliance on the service or any of the information or materials available on the service, regardless of the type of claim or the nature of the cause of action, even advised of the possibility of such damages and regardless of the cause of action under which such damages are sought, including, without limitation, breach of contract, negligence or other tort. You hereby waive any and all claims against the Service or OrientalFood, LLC and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the service and the sites and the information available thereon.

Because some states do not allow the exclusion of implied warranties or the limitation of liability for sequential or incidental damages, the above exclusions and limitations may not apply to you. In such states, our liability is limited to the greatest extent permitted by law.

Materials and comments post by Users

Service Provider does not endorse, support, sanction, encourage, verify or agree with the comments, opinions or statements posted by users in Interaction Areas or elsewhere in the Service. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the view of Service Provider.

Use of Service by Users

The Service includes Forum, Post your recipe and Feedback ("Interaction Areas") which allow you and other users to post information, provide feedback to us and interact in real-time.

Text, graphics, sounds or otherwise transmit on or through OrientalFood.com posted, linked or uploaded by users should not be any unlawful, harmful, fraudulent, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, material that is encrypted, constitutes junk mail, unauthorized advertising, violates the rights of others, encourages conduct that would constitute a criminal offense, or otherwise violates any applicable local, state, national or international law. You agree to use the Service only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability.

Although Service Provider may from time to time monitor some, all, or no areas of the Service for adherence to these terms of service or other OrientalFood, LLC terms of service that may be published from time to time, Service Provider are not under any obligation or liability to do so. You acknowledge that Service Provider can not prevent users from placing prohibited content on the Service and does not control the information available in the Interaction Areas and that any opinions, advice, statements, services, offers or other information or content presented or disseminated in the Interaction Areas are those of their respective authors who are solely liable for their content. Upon notification of inappropriate material, Service Provider and its affiliates reserve the right, but not the responsibility, to edit, refuse to post or remove any material submitted to or posted on the Interaction Areas.

You may not attempt to gain access to Service Provider's servers by any means - including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service other than connecting to Service Provider's servers via HTTP requests using a web browser.

You and any person who have access to the Service must not disrupt, modify or interfere with the Service, its associated software, hardware and servers. You further agree not to alter any information or materials on, or associated with, the Service.

Third party web link at Users' own risk

The Service Provider does not review or monitor any third-party World Wide Web sites and resources linked to the Service and are not responsible for the availability or content of any such linked web sites and resources. Therefore, any concerns a user may have regarding any other site should be directed to the relevant site administrator or webmaster. Your linking to such web sites is at your own risk.

Materials are properties of OrientalFood, LLC

The materials used and displayed on the Service, including but not limited to text, software, photographs, graphics, illustrations and artwork, video, music and sound, and names, logos, trademarks and service marks, are the property of OrientalFood, LLC or its affiliates or licensors and are protected by copyright as a collective work, pursuant to United States copyright laws. Any such content may be displayed solely for your personal, non-commercial use. You agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, circulate, create derivative works from, perform, display, or in any way exploit any of the content contained in the Service without the written permission of OrientalFood, LLC or the appropriate affiliate.

The information, advice, facts, opinions or other content appearing on the Service posted by users or third parties are those of the respective authors and do not reflect the views of OrientalFood, LLC. Service Provider assumes no responsibility or liability for these materials.

Use of materials post by Users

You may post, upload or link software files, text, sounds or otherwise transmit on or through OrientalFood.com that is not subject to any patent, trademark, copyright or other proprietary rights("Rights"), or Content in which any holder of Rights has given you express authorization for distribution on OrientalFood.com. Any communication or material you submit to any part of the Service, you automatically take the full responsibility to grant -- or warrant that the owner of such Content has expressly granted OrientalFood, LLC a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, transmit and display such Content (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content.

Termination

Harassment of another OrientalFood.com user on OrientalFood.com or via email is not permitted. Impersonation of others, including an OrientalFood, LLC employee or representative, a OrientalFood.com host or content producer, or another OrientalFood.com user is also forbidden.

Service Provider reserves the right to terminate your ability to access the Service, for any reason, without prior notice at any time. Service Provider may also impose limits on certain features or services contained in the Service without prior notice. USERS WHO VIOLATE THE TERMS OF SERVICE MAY PERMANENTLY BE BANNED FROM USING ORIENTALFOOD.COM.

Indemnification

You will be responsible for, and indemnify and hold harmless the Service Provider, its affiliates, employees, agents and representatives, from any and all claims and liabilities (including attorneys' fees) that may arise from any material that you post or transmit, from your unauthorized use of material obtained through the Service, from your breach of this User Agreement, or from any such acts arising through your use of the Service.

Disputes govern by New Jersey

This User Agreement and any disputes arising out of or related to the Service shall be governed by, and construed and enforced in accordance with, the laws of the State of New Jersey applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a state or federal court in New Jersey. In addition, you agree to submit to the personal jurisdiction and venue of such courts.

Demographic Information

You should be aware that if you voluntarily disclose personal information (e.g., user name, email address) in the Interaction Areas, that information can be collected and used by others and may result in unsolicited messages from other parties.

Revisions and additional rules

The Service Provider reserves the right to post, from time to time, revisions and additional rules of usage that apply to specific parts of the Service. Such revisions and additional rules will be posted in the relevant parts of the Service. Your use of the Service constitutes your agreement to comply with these additional rules.

This User Agreement is the complete and entire agreement between the Users and the Service Provider. It supersedes any prior agreement, whether written or oral.
